6. Analytics, Advertising, and Website Technologies

We use several third-party platforms and technologies to operate, understand, improve, and market our Services.

Shopify and Shopify Analytics

Our online store is hosted through Shopify.

Shopify processes information needed to provide our online store, including information relating to Site visitors, customers, accounts, purchases, transactions, and devices.

We also use Shopify Analytics to understand store traffic, customer activity, sales, conversions, and Site performance.

To help protect, grow, and improve our business, we use certain Shopify features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these features, Shopify may use personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, visit the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

We use Google Analytics 4 ("GA4") to help us understand how visitors use our Site.

Google Analytics may collect information about Site visits and interactions, including device information, approximate location information, pages visited, referral information, and other usage data.

Meta Pixel and Meta Business Tools

We use technologies provided by Meta Platforms, Inc., including the Meta Pixel and Meta Business Suite, in connection with advertising, measurement, and our Facebook and Instagram business presence.

These technologies may allow Meta to receive information concerning interactions with our Site, such as:

  • pages visited;
  • products viewed;
  • buttons clicked;
  • Site visits;
  • purchases or other conversion events; and
  • certain browser and device information.

Depending on our configuration and your privacy choices, Meta may use this information for advertising measurement, attribution, audience creation, and advertising services.

7. Social Media and Social Commerce

We maintain accounts on third-party social platforms, including:

  • Instagram;
  • Facebook; and
  • TikTok.

When you interact with us through these platforms, the platform operator may collect and process information about you according to its own privacy practices.

Information that you provide directly to us through these platforms may also be processed by EndoMe for purposes such as customer service, order management, marketing, or responding to inquiries.

Your use of Meta and TikTok services is also subject to the applicable platform's privacy policies and terms.

Depending on the technology, this information may include device and browser identifiers, IP addresses, Site interactions, advertising interactions, and conversion information.

Business and Commercial Partners

We may disclose information to business or commercial partners when necessary to provide a service you request or where otherwise described to you.

Legal and Compliance Purposes

We may disclose personal information if we reasonably believe disclosure is necessary to:

  • comply with applicable law, regulation, legal process, or governmental request;
  • protect the rights, property, or safety of EndoMe, our customers, or others;
  • investigate or prevent fraud, security incidents, or potentially unlawful activity; or
  • establish, exercise, or defend legal claims.

Business Transactions

If EndoMe is involved in a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred in connection with that transaction, subject to applicable law.

9. Sale, Sharing, and Targeted Advertising

EndoMe does not sell personal information for money.

However, some privacy laws define terms such as "sale," "sharing," or "targeted advertising" broadly.

Our use of advertising and analytics technologies, including technologies provided by Google and Meta, may constitute a "sale," "sharing," or use of personal information for targeted advertising under certain U.S. state privacy laws even where no money is exchanged.

Where applicable law provides you with the right to opt out of these activities, we will provide a means for you to exercise that right.

You can opt out through the "Your privacy choices" link at the bottom of every page of our Site.

Where required by applicable law, we also recognize qualifying browser-based opt-out preference signals, such as Global Privacy Control ("GPC").

10. Your Privacy Choices and Rights

Depending on where you live and applicable law, you may have rights relating to your personal information, which may include the right to:

  • request access to personal information we maintain about you;
  • obtain information about the categories of personal information we collect, use, or disclose;

These rights are not absolute and may be subject to exceptions under applicable law.

To submit a privacy request, contact us at hello@endomeus.com.

We may take reasonable steps to verify your identity before fulfilling a request.

Where permitted by law, you may also designate an authorized agent to submit a request on your behalf. We may require appropriate verification or proof of authorization.

We will not discriminate against you for exercising a privacy right provided by applicable law.

11. California Privacy Disclosures

California residents may have additional rights under California privacy laws.

Do Not Track and Global Privacy Control

Some browsers provide a traditional "Do Not Track" ("DNT") setting. There is currently no universally accepted industry standard governing how websites should respond to traditional DNT signals.

Separate from traditional DNT signals, certain jurisdictions recognize browser-based opt-out preference signals, including Global Privacy Control ("GPC").

Where applicable law requires us to recognize a valid opt-out preference signal, we will process that signal as required by applicable law.

California Consumer Privacy Act

If EndoMe is subject to the California Consumer Privacy Act, as amended ("CCPA"), California residents may have rights including the right to:

  • know what personal information we collect;
  • access certain personal information;
  • correct inaccurate personal information;
  • request deletion of personal information;
  • opt out of the sale or sharing of personal information;
  • limit certain uses and disclosures of sensitive personal information, where applicable; and
  • exercise their privacy rights without unlawful discrimination.

Where the CCPA applies to EndoMe, we will honor these rights as required by law.

Requests may be submitted to hello@endomeus.com.

Privacy choices relating to cookies, advertising technologies, or the sale or sharing of personal information are also available through the "Your privacy choices" link on our Site.

12. Consumer Health Data

Certain U.S. states have enacted laws that specifically regulate consumer health data, which can include information relating to an individual's physical or mental health and, in some circumstances, information from which health status may be inferred.

Because EndoMe provides products and educational content relating to women's health and endometriosis, certain interactions with our Site could potentially involve or generate information subject to these laws.

To the extent such consumer health data laws apply to EndoMe, we will collect, use, disclose, and otherwise process consumer health data in accordance with applicable law.

Where required, EndoMe will provide a separate Consumer Health Data Privacy Policy, consent mechanism, or consumer rights process applicable to such information.

13. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to:

  • provide our Services;
  • fulfill orders;
  • maintain customer and transaction records;
  • provide customer support;
  • maintain appropriate business records;
  • comply with legal, tax, accounting, and regulatory obligations;
  • resolve disputes;
  • prevent fraud or abuse; and
  • enforce our agreements.

Retention periods vary depending on the type of information, the purpose for which it is processed, and applicable legal requirements.

When personal information is no longer reasonably necessary, we may delete, anonymize, aggregate, or otherwise dispose of it in accordance with applicable law.

14. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of personal information.

15. International Visitors

You must be at least 18 years old to purchase products from EndoMe.

We do not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete it.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "sell" or "share" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

If you believe a child has provided personal information to us, please contact us at hello@endomeus.com.

17. Third-Party Websites and Services

Our Site may contain links to websites, social media platforms, payment providers, or services operated by third parties.

We are not responsible for the privacy, security, or data-handling practices of third-party websites or services.

We encourage you to review the privacy policies of third parties before providing them with personal information.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our business, practices, technologies, Services, or legal requirements.

When we make changes, we will update the Last Updated date at the top of this Privacy Policy.
